		<description>Good find!  The funny thing is, that &lt;em&gt;technically &lt;/em&gt;is not a split between the various state courts.  The Wisconsin Court held there is no violation of &lt;em&gt;Federal &lt;/em&gt;Constitution, while the NY Court that there WAS a violation of the &lt;em&gt;NY &lt;/em&gt;Constitution.  States can have more protective (of citizens) constitutions, so you can get situations like this where there is no protection under the Federal Constitution, but there IS a right protected under a state constitution.

But then again, as quoted in the article you linked, the language is the same for both the Fourth Amendment and the NY Constitution.  So we'll just have to see if this issue works its way up to the Supreme Court...</description>
